Registered
Trademark: Quazant®
On October 1, 2002, the United
States Patent and Trademark Office officially approved “Quazant”
as a registered trademark, thereby affording the company all the
protection associated with such a registration.
Federal registration has
several advantages including public notice of our claim of ownership
of the mark, a legal presumption of ownership nationwide, and the
exclusive right to use the mark on or in connection with the goods or
services set forth in the registration.
Prior to filing a trademark
application for “Quazant®,”
the company authorized a full Thompson & Thompson trademark search
for “Quazant” in an effort to conclusively determine the
uniqueness of the name.
That search did not produce any
mark likely to prohibit registration or to cause confusion with any
other existing mark currently being used in commerce.
Based on the favorable search results, we prepared and filed
the application with the U.S. Patent & Trademark Office.
The United States Supreme Court has made the importance of trademarks
rather clear. It stated, "The protection of trademarks is the
law's recognition of the psychological function of symbols. If it is
true that we live by symbols, it is no less true that we purchase
goods by them. A trademark is a merchandising short-cut which induces
a purchaser to select what he wants or what he has been led to believe
he wants. The owner of a mark exploits this human propensity by making
every effort to impregnate the atmosphere of the market with the
drawing power of a congenial symbol. Once this is obtained, the
trademark owner has something of value".
